Guantánamo Bay

Under what laws are people held and tortured at Guantánamo Bay detention camp?

Though United States operate an overseas naval base following the Cuban-American Treaty of 1903, containing a military prison since 2002, the Cuban government opposes the presence claiming that the lease is invalid under international law as it was not a sovereign nation at the time.
If Cuba ratified the lease with full sovereignty, I would like to see the justification in full details.

Do people of America have power to control their fictional government, specially when carrying inhuman and evil acts?

What is the practical solution to respect humanity and to condemn such acts as unlawful?
No fiction can lawfully exist as second, if proven unlawful.

I am discussing here about people with flesh and blood who have feelings, not fictional 'prisoner' states defined on paper.

If agreed state parties change, the lease becomes void. I would like to see the terms of the new contract agreed after consideration. Please reference it to me for analysis.
Can you be sure that U.S. has always being within the terms of contract without any controversial issues?

  1. I watched a news report when i was overseas about how a psycholtic cia contractor.was.blowing up planes etc for.terrorists. He was.arrested, but the cia bailed him out because they needed him for their work and he was very good. This.was two years ago. Google it. Thats the **** America does.

  2. The concentration camp at Guantanamo Bay is not subject to the laws of the USA or of Cuba. Keeping prisoners without trial when war has not been declared is a crime in International law. That is why the USA has not signed up to the International Court of Justice - if they had everyone from Presidents to gaolers would be in the dock at the Hague.

    The UN Security Council cannot condemn the USA for criminal acts since the USA would simply use their veto. No-one can impose International law on the USA since they are the most heavily armed nation on Earth. However, the USA is $17 trillion in debt. If China ups the interest rate by 3%, the USA would be bankrupt and unable to pay its military or the CIA. It will be interesting to see how many guards at Guantanamo continue to work for nothing.

  4. Cuba has made claims against Guantonamo for almost 60 years, and they have never stood up to scrutiny. In the first place, the treaty was signed by the President at the time. Post revolution Cuba is the legal heir of that government, so is bound by the lease. Secondly, Castro's government accepted a lease payment after the revolution, effectively accepting the lease as written.

    As for why the US is legally able to hold and torture prisoners, that is simple: the US only obeys 'international law" when it suits them. Since no other nation has the power or seemingly the WILL to stand up to the US bully, they can effectively ignore international law or rights. The US public seems to be okay with that position, making them complicit in the crimes.

  5. When Obama was running for president he made the American people a promise to close Guantanamo Bay. He has also increased the Military Industrial Complex which he had promised to scale down. He is a terrible liar.
