Constitution of Sri Lanka states:

93. The voting for the election shall be FREE, equal and by secret ballot.

Voting for an election can be free only if electors are outside the system (not defined in constitution).

But,
26.(2) : entitlement to citizenship as by descent or by virtue of registration
89.(a) : No person shall be qualified to be an elector if he is not a CITIZEN of Sri Lanka

Liberation = Freedom is false

If citizens defined under the fictional constitution (subject to privileges and punishments) are not free, can there votes be free?

Constitutionally, can voting of Citizens for any election be FREE in Sri Lanka?

  1. Citizens are free to vote in many countries but they can vote for who available for them. This is the first restriction of reality. Nobody is perfect but they have always have good intention in open mindedness.

    Whoever involved in electoral process got to be corrupt proof. This electoral commission must be independent, accessible by the people through media and scholars. Its history must be written down in details. Usually I think the government selects them but if so, we shouldn't like it. The commission itself should select the people it likes and they must not serve more than once. They should select the next generation of members and train them. There should be nobody above them ordering them what to do. Members must come from the intellects such as judges, lawyers, scientists, teachers, different kinds of workers including soldiers etc. (This is important to many countries such as Burma).

    For the citizens, it depends on who they listen to. If the constitution is insufficient, they can't vote freely. The constitution must be test-proof and available for challenge. Anyone must be allowed to criticize it in constructive manner. Pointing out the loopholes is necessary and citizens must be protected by law, political system, and other means to criticize whatever whoever they want. Freedom of speech is the must.
